TERMS AND CONDITIONS OF CHARTER

DEPOSIT: A charter is only confirmed upon receipt of a 50% deposit

BOND: A bond of $3000 in form of a credit card authorization must be paid 24 hours before the charter date. The bond will not be repaid in the event of: - Breach of charter conditions - Loss or damage to the vessel or fittings - Unruly behaviour - Causing the Master (captain) to terminate the charter early in concern of the safety of other passengers, crew and the vessel

CANCELLATION:
Deposits are non-refundable, except in the condition where more than 30 days prior we are successful in rebooking the vessel at your scheduled charter date and time.
Cancellations between 30-10 days will forfeit the deposit.
Cancellations less than 10 days prior will require costs to be paid in full, with consideration given to staffing, food and boat costs associated with cancellations.

CATERING: Final number of passengers must be confirmed no later than 7 days prior to the charter. Within 7 days of the event, when confirmed by your event coordinator prior, numbers may increase however a decrease in numbers will incur the total cost of the balance invoice issued. Please note that pricing and catering options are subject to change based on seasonal availability.

FINAL PAYMENT: Any outstanding invoices including the remaining vessel hire, catering, staff or wharf fees are due 14 days prior to the charter. Additional expenses incurred on board are required to be paid before disembarking.

COVID 19 – FREE CANCELLATION POLICY:
If COVID-19 restrictions imposed by Government prevent your carter from going ahead as planned, you will be offered either a postponement to another available date within a year, or a full refund. This COVID-19 Cancelation policy must be applied at least 7 days prior to the charter date. Any other reasons due to COVID-19 restrictions do not apply to this cancellation policy and normal terms and conditions apply.This policy comes into place with the following conditions;
- The vessels passenger limit has changed due to COVID-19 restrictions, and the passenger limit is lower than the original passenger numbers booked for that charter.
- The vessel is not able to operate as a service due to COVID-19 restrictions.

USE OF THE YACHT In booking Oscar II, the charterer agrees that

- No more than the specified number of guests in the balance invoice will board the yacht, including prior approval for all outside entertainment, including DJ’s, photographers, waitstaff, chefs etc
- Children must be under the control of a responsible adult. That adult is responsible for the conduct and personal safety of the children while on board the yacht. Children are strongly encouraged to wear a lifejacket for the duration of the charter.
- Compliance with the Laws and Regulations of the State and Australia.

SWIMMING AND WATER ACTIVITIES
All water activities must be prior advised to your event coordinator no more than 48 hours before the charter and are reserved for smaller groups. It is up the captain’s discretion on the day whether guests will be able to engage in water activities/swimming. Additional costs may be incurred. No more than 20 guests are allowed in the water at any one time, unless a lifeguard has been organised prior to charter. The use of the jacuzzi is available with prior request only and is reserved for smaller groups. Towels are to be provided by the guest.

DURATION OF THE CHARTER:
Charter time includes the time for passengers to board and disembark the vessel. Additional time required to disembark past 15 minutes will be charged pro rata. If you require earlier access to the vessel for styling and/or pack down, additional fees may apply. Please confirm with your charter manager before arranging with your suppliers. Any items left on board will only be kept for 48 hours, after which time they will be disposed of if not yet picked up.

CHARTER COURSE: The Captain of the charter reserves the right at their own discretion to alter the agreed course because of weather, traffic or any other cause which they believe is justified in the concerns of the safety of passengers, crew and the vessel.

RESPONSIBLE SERVICE OF ALCOHOL
The vessel operator practices the responsible service of alcohol, and therefore will refuse service to any intoxicated patrons. Offenders with excessive consumption of liquor may be prosecuted for dangerous, rowdy, unruly behaviour as it is against the law.

LIMIT OF LIABILITY:
(i) it is a condition of the charter that the liability of the Operator, its servants, agents and sub-contractors is agreed to be limited in accordance with the Limitation of Liabilities and Maritime Claims Act 1989 (Cth)

NO SHOE POLICY
Oscar II has a strict no shoe policy on board.
