BOOKING TERMS & CONDITIONS
In the event the weather on the day of your experience is deemed unfit by the operator you will be given the option to reschedule your experience free of charge for another time, or you may request for the full amount to be transferred onto a Gift Voucher. Gift vouchers are valid for five years from date of issue. The operator does not offer cancellations and/or refunds on issued Gift Vouchers. The operator does not offer refunds on Experiences that have been cancelled or rescheduled due to weather or other unforeseen circumstances unless you can prove you are visiting from overseas.
In the case that the vessel is not available for a pre-organized event due to a system failure, the provider reserves the right to assign another vessel of equal size and quality for the organized event at their own discretion.
Cancellations may be made at the operator’s discretion due to mechanical breakdowns, which may result in the vessel being unable to operate. If the operator is unable to assign another vessel of equal size and quality for the organized event the customer will receive a full refund of the fare price.
Amendment Charges
Rescheduling with more than 14 days notice to the booking date requires no charge.
Rescheduling with less than 14 days notice to the booking date requires a $100 admin fee.
Rescheduling with less than 48 hours notice results in a 50% loss of booking fee.
Departure Days, Times And Pick Up Points
Most of our cruises are available daily and depart from either Campbells Cove, Circular Quay or the Convention jetty in Darling Harbour. For days and times, please refer to the product sheets provided by the operator. It would be appreciated if passengers could arrive 10 minutes before scheduled departure time.
Public Holidays
The rates for Public Holidays are POA. Please note that we only run bespoke charters on the following public holidays:
Payment Policy
The balance of the event account is due 14 days prior to the charter date
Damages And Responsibilities
The customer assumes the responsibility for any and all damage or loss of merchandise left aboard ‘MV BEL’ during a tour. It is the customers responsibility to ensure that all guests are aware of the risks involved in leaving personal items unattended. Guests should arrange their own insurance. The customer also assumes responsibility for any and all damage caused by him/her or any of his/her guests, invitees or other persons attending the tour.
Liability
It is a condition of the trade terms and conditions agreement that the liability of the Operator, its servants, agents and sub-contractors is agreed to be limited in accordance with the Limitation of Liabilities and Maritime Claims Act 1989 (Cth).
The Customer agrees to indemnify and hold harmless ‘Prestige Harbour Cruises’, its agents and employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines and liabilities (including reasonable legal fees) caused by any negligent act or omission by ‘Prestige Harbour Cruises’ or members of the Customers group. The Operator is not liable for any death, loss, damage or injury to any person or property which occurs and is attributable to or associated with:
i- Failure to follow any reasonable direction given by the master or crew;
ii- Failure to comply with any of these terms or conditions;
iii- Failure to comply with any warning sign;
iv- Unreasonable or unsafe behavior;
v- Willful misuse of the equipment or facilities of the vessel;
vi- Intoxication or the use of prohibited drugs.
