Effective upon payment of deposit the booking client is deemed to have accepted the following conditions and terms:
Availability of SWIMMING
The Broadwater is often subject to dangerous currents and swimming is permitted only by prior arrangement and at certain safe locations in the Broadwater. If your party wishes to swim, this MUST be pre-arranged and the time of the cruise must be selected carefully to fit in with tide times. At all times, swimming is only permitted at the discretion of the Skipper.
Man OVERBOARD
The Australian Maritime Safety Authority (AMSA) mandates any unauthorised entry to the water as a ‘Man Overboard’ situation and requires the vessel to return to port and terminate the cruise immediately. Should a guest of the Bacchus enter the water without express permission from the Skipper, AMSA rules be followed and no refund/compensation will be provided.
INTOXICATION or ILLEGAL DRUG USE
The Operators of MV Bacchus, Skipper and Deckhands reserve the right to deem it unsafe at any point prior to or during the cruise for any intoxicated guest to continue drinking or move around the vessel. Should any guests arrive intoxicated prior to departure they may be denied boarding. Guests must comply if instructed to discontinue drinking at any point during the charter period. Possession or consumption of illegal drugs aboard the vessel will result in immediate cancellation of cruise and return to shore. Police will be contacted at the Skipper’s discretion.
SAFETY
Dangerous or illegal activity during the course of a cruise may result in immediate cancellation and return to port at the discretion of the Skipper. The master on the vessel reserves the right to terminate the cruise and return to the nearest drop off point without any compensation to the passenger or booking agent.
Standard DISCLAIMER
The operator of the MV Bacchus shall not be liable for any death, personal injury, or loss or damage to property and it is a condition of entry that you hereby release, to the full extent permitted by law, the operator and its employees, agents, and subcontractors from all actual and contingent liability in respect of personal injury, death, loss or damage.
Following SKIPPER INSTRUCTIONS
All passengers shall comply with any direction given for the safety of the vessel and comfort of passengers and agree that wilful disobedience means that they may be immediately taken to the nearest port or the embarkation point without refund. It is a condition of entry that a passenger indemnity the operator for all wilful damage caused by that passenger.
FAILURES and DAMAGES
Any damage caused to the vessel by a guest must be paid for, unless the part/equipment/property is deemed to be damaged or faulty. Deliberate damage or graffiti will be reported to the police upon return to shore.
All care and maintenance are applied to our onboard cooking facilities but should there be a failure of the BBQ or other cooking/kitchen appliance, our deckhands will offer you alternative options such as our microwave, oven, BBQ, hotplates or electric frypans.
CANCELLATION
If, for any reason, the owner, their employees or agents cancel a charter on, or prior to, the day of your booking, an alternative date shall be offered. If this is not workable, then a full refund will be provided within 7 working days. The hirer shall have no additional claim on any account against the operator, its management or agents and contractors. Please note – inclement weather is not an acceptable reason for cancellation unless it is deemed dangerous by the operator or skipper.
For the duration of COVID-19 economic shutdown and mandatory social distancing – all deposits and payments will be returned should your charter be impacted by government man dated social-distancing of home lock-down policies. Please note that acceptance of a cancellation will be based on official Government Stage recommendations. EG: should you have a party booked for 40 and recommended numbers for social distancing are reduced to under 20, your cancellation will be accepted. Please Note: If you decide you would be more comfortable cancelling as your friends have decided not to come – your cancellation will not be accepted. The operators are open to date changes and postponements.
Non-Covid-19 REFUND POLICY
Up to 14-days prior $1200 fee (Rebooking at a later date is available)
13 - 7 days prior: 50% refund of the total quoted full price paid
7-0 days prior: No refund
