TERMS AND CONDITIONS OF CHARTER
These Terms & Conditions are non-negotiable and form part of every booking. These Terms & Conditions are incorporated into every booking and form part of the booking contract between the client, the booking agent (Prestige Harbour Cruises) and Aussie Princess Boat Charter.
By confirming a booking, the booking agent acknowledges these conditions, agrees to communicate them to the booking party prior to the charter and agrees to collect and hold the required Security Bond on behalf of Aussie Princess Boat Charter.
1. Security Bond
A $500 Security Bond is required for every Buck’s Party booking.
The booking agent is responsible for collecting and holding the Security Bond.
The Security Bond may be returned by the booking agent following completion of the charter unless advised otherwise by Aussie Princess Boat Charter due to a breach of these Terms & Conditions.
The Security Bond does not limit liability. Where damage, excessive cleaning, repairs or other costs exceed $500, the booking party remains liable for all additional costs incurred.
2. Authority of the Master
Aussie Princess Boat Charter operates under Australian and Queensland maritime legislation governing commercial vessels.
The Master (Captain) has a legal responsibility to ensure the safety of passengers, crew, the vessel and other waterway users.
To fulfil these obligations, the Master has absolute authority over the operation and management of the vessel throughout the charter.
The Master may, at their sole and reasonable discretion:
• Refuse boarding to any guest.
• Remove any guest from the vessel at the next safe and practical public jetty.
• Return the vessel to the marina.
• Terminate the charter immediately.
• Contact Queensland Police Service, Maritime Safety Queensland or any other emergency or regulatory authority where considered necessary.
The Master may determine whether a breach of these Terms & Conditions has occurred based on their own observations, the observations of crew members and any other relevant information available at the time.
The Master’s determination that a breach has occurred is final while the charter is underway and is not subject to discussion or negotiation onboard.
Failure to comply with any lawful direction given by the Master or crew may result in removal from the vessel or immediate termination of the charter without refund. The safety of the vessel will always take priority over continuation of the charter.
3. Responsibility of the Booking Party
The booking party accepts responsibility for the conduct and behaviour of every member of their group.
The actions of one guest may result in consequences for the entire booking where, in the opinion of the Master, those actions affect the safety, operation, reputation or enjoyment of the charter.
4. Smoking & Vaping
Queensland legislation regulates smoking and vaping in many public places and licensed venues. Aussie Princess Boat Charter adopts a strict zero-tolerance policy consistent with these requirements.
4. Smoking and vaping are prohibited anywhere onboard at any time.
This includes:
• Cigarettes
• Cigars
• Electronic cigarettes
• Disposable vapes
• Rechargeable vaping devices
• Any other smoking or vaping device
This policy is absolute and is not subject to personal preference, habit, addiction or opinion.
Guests who are unable to refrain from smoking or vaping for the duration of the charter should not book this vessel.
If any guest is found smoking or vaping onboard:
• The $500 Security Bond will be forfeited.
• The offending guest may be removed from the vessel at the next safe and practical public jetty.
• The Master may terminate the entire charter immediately if the conduct of the group warrants doing so.
• No refund or compensation will be provided.
No warnings will be given. No exceptions will be made.
5. Illegal Drugs
Illegal drugs are strictly prohibited.
Any guest found using or in possession of illegal drugs may be immediately removed from the vessel.
The Master may terminate the charter immediately without refund.
The $500 Security Bond will be forfeited.
Queensland Police Service or Maritime Safety Queensland may be contacted where considered appropriate
6. Vomiting
If any guest vomits onboard:
• The $500 Security Bond will be forfeited.
• The offending guest may be removed from the vessel.
• The Master may terminate the charter if they determine the behaviour of the group is no longer appropriate.
Any additional cleaning costs exceeding the Security Bond remain payable by the booking party.
7. Marine Toilet
A compulsory toilet briefing will be conducted before departure.
Only the following may be flushed:
• Human waste.
• Toilet paper supplied onboard.
The following must never be placed into the marine toilet:
• Wet wipes
• Baby wipes
• Paper towel
• Tissues
• Sanitary products
• Condoms
• Food
• Rubbish
• Cigarette butts
• Vape packaging
• Any foreign object
If the toilet becomes blocked due to guests failing to follow the toilet briefing:
• The $500 Security Bond will be forfeited.
• The Master may terminate the charter immediately.
• Any repair costs exceeding the Security Bond remain payable by the booking party.
8. Alcohol
Guests are welcome to bring their own alcohol.
Beer, pre-mixed drinks, seltzers and similar beverages must be in cans only.
Glass bottles are permitted only for:
• White wine
• Champagne
• Sparkling wine
Red wine is strictly prohibited onboard due to the permanent staining it causes to marine upholstery and decking.
9. Footwear
Aussie Princess is a shoes-off vessel.
All guests must remove footwear before boarding unless otherwise directed by the Master for safety or medical reasons. This policy exists to protect the vessel’s white fibreglass decks, upholstery and finishes from scuff marks, staining and damage. Guests who fail to comply with this requirement after being directed by the Master may be removed from the vessel or the charter may be terminated.
10. Food & Decorations
Guests are welcome to bring their own food and decorations. Decorations must not damage the vessel or leave adhesive residue. Confetti, glitter, coloured powders and similar products are strictly prohibited.
11. Entertainers
Buck’s Party bookings may have professional entertainers at the booking party’s expense. To be engaged by either the booking agent or princess charters only never by the customer directly and subject to the following conditions:
• Prior approval from Aussie Princess Boat Charter is required.
• Entertainers are permitted to provide topless beverage service only.
• Full nudity is strictly prohibited.
• Strip shows or stage performances are not permitted.
• Private dances are not permitted.
• Lap dances are not permitted.
• Physical or sexual contact between entertainers and guests is not permitted.
• Entertainers must comply with all directions given by the Master and crew.
Guests must not:
• Touch, harass, intimidate or interfere with entertainers or crew.
• Use inappropriate language or behaviour.
• Engage in unwanted physical contact.
Any breach of this section may result in:
• Removal of the offending person.
• Forfeiture of the Security Bond.
• Immediate termination of the charter without refund.
The Master has final authority regarding acceptable behaviour onboard.
12. Damage
The booking party is responsible for all loss or damage caused by any member of their group.
This includes, but is not limited to:
• Vessel damage.
• Upholstery damage.
• Toilet repairs.
• Excessive cleaning.
• Damage to equipment.
• Damage to fixtures or fittings.
Costs exceeding the Security Bond remain payable by the booking party.
13. Refusal of Boarding
The Master reserves the right to refuse boarding to any guest whose behaviour, intoxication or conduct is considered likely to compromise:
• Safety of the vessel.
• Safety of passengers or crew.
• Operation of the charter.
• Enjoyment of other guests.
No refund or compensation will be payable where boarding is refused under this clause.
14. No Refunds
No refund, credit or compensation will be provided where:
• A guest is refused boarding.
• A guest is removed from the vessel.
• The charter is shortened.
• The charter is terminated.
Where such action results from a breach of these Terms & Conditions or the lawful exercise of the Master’s authority.
15. Acceptance
Confirmation of a booking constitutes acceptance of these Terms & Conditions by both the booking agent and the booking party.
The booking agent acknowledges responsibility for ensuring these Terms & Conditions have been provided to and accepted by the booking party before commencement of the charter.
