TERMS & CONDITIONS OF CHARTER
Definitions
Charter: the hire of the yacht from the operator by the Charterer, the Charter being an overnight stay or skippered yacht charter.
Charterer: The client.
Charterer’s Group: All the passengers who will take part in the Charter.
Vessel operator: Licensed owner operator of the vessel
Agent: Third party booking sales agent
Skippered Yacht Charter: A skippered charter departing from the nominated wharf for duration booked by the Charterer.
Overnight Stay: An Overnight Stay. Guests are picked up from the nominated wharf, an induction on the yacht is conducted by a TME staff member and guests stay onboard (without a staff member), picked up and taken ashore at end of duration of Charter.
Experience: Either a Day Charter or Overnight Stay.
Skipper: Qualified person in charge of the yacht or Tender.
Booking: Full payment made and booking confirmation issued.
Wharf: Palm Beach Ferry Wharf, Pittwater Park, Palm Beach
General Safety
Sailing on a yacht is a fantastic experience but can contain an element of risk. Please be aware of your surroundings when the sails are up. There is a risk of personal injury by things such as flapping sails, loose lines (ropes) around cockpit and foredeck areas, the boom moving about over your head, open hatches on foredeck and general movement of yacht caused by wind and waves. Be aware that wash from other boats can cause sudden waves that can rock the yachts momentum.
Whilst every care is taken to ensure your safety, we do not accept responsibility for injury, damage or loss incurred for the duration of or in subsequent relation to the charter. You must obey any instruction given by the yacht Skipper.
Only get on/off the yacht or tender once tied up and Skipper has advised it is safe to do so.
If you leave the vessel to enter the water, you do so at your own risk, and you are responsible for your safety.
Always use sunscreen, all yachts have SPF50 onboard for your use.
The Skipper may terminate your Charter immediately if your behaviour is inappropriate such as displaying signs of heavy intoxication, be under the influence of an illegal substance, cause distress, damage, danger, harassment or annoyance to any guest or staff member, or you refuse to comply with instructions or orders of staff. Under these circumstances no refund will be available.
Please inform us prior to your charter if you have any food allergies or health conditions which may affect your safety on the skippered yacht charter or overnight stay. We will do our uttermost to ensure your safety and cater to any allergies, but we do not take responsibility should you have a negative reaction to something out of our control. You enter onto the yacht at your own risk with due regard to the risks involved in the activity.
We recommend suitable clothing for boating along with appropriate and comfortable rubber soled footwear. No dark soled shoes, stilettos, or high heels are permitted on the yachts.
We take no responsibility for guest personal belongings while on the wharf, in tender or on yacht.
All yachts have fire extinguishers, fire blanket and a first aid kit onboard.
If at any time you are feeling unsafe or unwell, please let your Skipper know so they can try to make you more comfortable.
If prone to motion sickness, please take medication prior to Charter e.g. Travel Calm, to help settle you, these should be taken at least 12 hours prior to arrival, always follow dose recommendations.
Weather
We want you to always feel safe and comfortable while on Charter, please read the following carefully:
Charters still proceed if the weather is raining, overcast, lack of wind, scattered showers, cool or any other weather factor that is not making it unsafe to operate.
Unsafe weather including high winds, heavy rain, storms and rough seas, as determined by your Skipper, may require your Charter to be rescheduled to another date. Postponements initiated by Taylor Made Escapes will be rescheduled at the earliest mutually convenient date.
Our Skipper will determine if it is unsafe to proceed and may contact you prior to Charter to raise as it as a possibility.
You will have one opportunity to reschedule if we postpone. Any cancellation or postponement of rescheduled Charter by you will result in forfeiture of full charter fee.
Bookings, Postponement & Cancellation
The operator reserves the right to accept or reject a booking for any reason.
A booking confirmation will be sent via email on receipt of a 50% deposit, final payment is required 14 days prior to the charter date.
If you cancel after payment, more than 14 days prior to the Charter departure date you will forefeit your 50% deposit.
If you postpone a Charter more than 14 days prior, you can change it once only. A postponement between 14 and 7 days has a fee of $100 and the new date is subject to availability. A Charter cancelled within 14 days of Charter date departure will not receive a refund. All prices are in AUD and include GST.
A Charter cannot be postponed within 7 days of booked departure date unless by mutual agreement under exceptional circumstances.
Failure to arrive at the nominated location and board time or ‘no shows’, are deemed a cancellation and no refund will be given.
Overnight Stay
On boarding, a comprehensive induction is given by our staff to familiarize you with features, safety equipment, kitchen/bathroom etc onboard the yacht. We ask you to sign a form stating this induction has been carried out.
All yachts are on permanent moorings located South of Palm Beach Ferry Wharf & not far off Snapperman Beach/Pittwater Park.
Under no circumstances may the yacht be moved off the mooring by the Charterer. There is no exception to this rule.
A $100.00 fee is applicable for any call out from yachts during overnight stays. This fee is exempt in the event of exceptional circumstances such as a weather or serious medical emergency as determined by the vessel operator.
A rowing dinghy is provided for your use. If planning to spend time or dine ashore, please ensure the dinghy is pulled far enough up on the sand so it does not float away. A lifejacket must be worn when rowing alone or by all persons after sunset.
We are not responsible for the operation of rowing dinghy. If needed, we will give you a rowing demonstration during the induction but if you wish to learn more go to YouTube & search - How to Row a Boat.
Any equipment including and not limited to, seat cushions, dinghy, oars or lifejackets lost during the stay will be charged to the Charterer.
Boarding time at Palm Beach Ferry Wharf will be stated on the booking confirmation. Failure to be on time without sufficient notice may forfeit your stay with no refund. If you are running late, as a courtesy please contact us en-route.
Late arrivals incur a fee of $100 per hour for our Staff to wait for you. This fee will commence 30 minutes after the agreed departure time and must be paid prior to being taken to the yacht.
Social Media
The Skipper/Photographer will may permission to take photos or video with the subject/s of the image. If you do not wish to be in social media posts, images, website or marketing material please advise the Skipper on boarding or prior to your experience.
